Chapter 23: Assault in the Examination Room

Around the same time period that Joan filed her retaliation complaint with MCAD, she also started studying in depth, the documents which had been presented to the courts by the MSP. She was infuriated when she uncovered the many misrepresentations, half truths and complete lies that likely led to her denial for the Ordinary Disability (50%) request. She would now go back to request what the Attorney General's Office originally concluded she was due, Accidental Disability (72%).


She wrote a letter to the new Commissioner. Joan knew him, he was another one of the good guys, and she knew she could trust him. However, she was also aware of the powerful and corrupt faction within the MSP. She knew that he may not be aware of nor able to address it. He did arrange for an appointment for a physical exam for Accidental Disability with a new State Police Surgeon.


When she walked into the doctor's office for her examination, he immediately said to her in an angry voice and his finger in her face, "You wait here. I want to find out who your are." He was gone for 15 minutes, and upon his return he remained hostile throughout the whole exam. When Joan handed him a compilation of all her doctor's reports, he barked at her, "I can't read all of that." He obviously didn't, because his report ultimately stated, "I do not find a causal connection between the motor vehicle accident....and her subsequent complaints of TMJ." This same argument had been nullified YEARS prior by Dr. Mehta of Tufts TMJ Dental Clinic.


At one point during the exam, when Joan was facing away from him, the surgeon slapped her on the back so hard that she reeled around in horror and exclaimed, "Why did you just hit me?" His answer was very strange. "Did you say your back hurts??" She was shocked by his physical abuse. It was ever so clear to her that he had malicious intentions.


She often wondered if she had reported the assault, how he would have explained his actions. Would it come down to her word against his??? OR...would he try to say that she made it up? Should she request that he be given a polygraph? She knew he wouldn't pass one.


She just could not take on one more battle so she kept it to herself!!
